Terms of Service

These terms govern the use of the BaanHost application and website ("the Service"), operated by Baan Paro Mruen, Koh Phangan, Surat Thani, Thailand ("BaanHost", "we"). By creating an account you agree to them on behalf of the organization you register.

1. The Service

BaanHost is property-management software for accommodation businesses: bookings, availability, guests, payments, housekeeping, messaging, channel synchronisation, registration exports and finance. We may add, change or retire features; we will not remove a feature that materially reduces what you paid for during a paid period without offering a refund for the remainder.

2. Accounts and trial

One person creates an organization and becomes its owner; the owner invites staff and sets their roles. You are responsible for keeping logins confidential and for everything done under your organization's accounts. New organizations receive a free trial of 14 days with all features. When the trial ends without a subscription, the organization becomes read-only until a subscription is activated.

3. Subscriptions and payment

• Plans are priced per organization by the number of units and are offered for 1, 3, 6 or 12 months; every plan includes all features, channel sync and unlimited staff. Current plans and prices are shown on the subscription screen in the app and on baanhost.com.
• In the iPhone and iPad app, subscriptions are purchased through Apple's App Store and charged to your Apple ID when you confirm the purchase; in the Android app they are purchased through Google Play and charged to your Google account. Only an owner of the organization can buy or change its subscription, and the subscription applies to that organization.
• Subscriptions renew automatically at the end of each period at the then-current price unless cancelled at least 24 hours before the period ends. You can manage or cancel a subscription at any time in your App Store account settings or in Google Play subscriptions; cancelling stops future renewals and access continues until the end of the period already paid.
• Refunds for store purchases are handled by Apple or Google under their own policies.
• If a subscription ends without renewal there is a 7-day grace period; after that the organization is read-only. Data of organizations that stay read-only may be permanently deleted after the retention period stated in the Privacy Policy.
• Price changes are announced in advance and follow the store's rules; they never apply to a period already paid.
• When you download the app from Apple's App Store, Apple's Licensed Application End User License Agreement (EULA) also applies, together with these terms.

4. Your data

Bookings, guest details, finances and everything else you enter belong to you. You are the data controller for guest personal data; BaanHost processes it on your behalf under the Privacy Policy. You can export all of your data at any time from the app and delete your account. You are responsible for entering guest data lawfully and for any registration or reporting duties that apply to your business.

Support access. To investigate a problem you report, or to set up a service you asked for, BaanHost support staff may sign in to your organization with the same view as your owner account. Every such session requires a stated reason, is limited to one hour, and every action taken during it is written to your organization's audit log marked as performed by BaanHost support. We do not use this access for any other purpose.

5. Acceptable use

Do not use the Service to break the law, to store data you have no right to, to probe or overload our systems, or to resell the Service. Third-party platforms you connect (Booking.com, Airbnb, Agoda, Expedia, payment gateways) have their own terms, which you accept directly with them.

6. Availability and backups

We aim for the Service to be available at all times and keep nightly backups, but we do not guarantee uninterrupted operation. Planned maintenance is announced in advance where possible. Availability pushed to third-party platforms depends on those platforms; you remain responsible for checking your calendars.

7. Liability

The Service is provided as is. To the extent permitted by law, BaanHost is not liable for indirect losses such as lost bookings or profits, and our total liability for any claim is limited to the fees you paid for the Service in the twelve months before the claim.

8. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate an organization that breaches these terms or does not pay, after notice where reasonable. On termination you can export your data during the retention period.

9. Changes and law

We may update these terms; material changes are announced in the app or by email at least 30 days in advance. These terms are governed by the laws of Thailand. Questions: [email protected].
